These Terms of Service ("Terms") are a legal agreement between you (the user, whether an individual or acting on behalf of a legal entity) and LawSaathi LegalTech Private Limited (“LawSaathi”, “we”, “our”, or “us”). These Terms govern your use of our platform, tools, content, products, and services including DELTA, LawSaathi Lens, Case Drafting, and all related applications (collectively, the “Services”).

By using or accessing our Services in any manner, you agree to be legally bound by these Terms. If you do not agree, do not access or use the platform.

LawSaathi is a legaltech platform designed to simplify legal information and services for the general public, advocates, lawyers, law students and legal professionals. We provide intelligent tools, including our AI-powered assistant DELTA, to help users understand legal matters, access judgments, draft documents, and much more—instantly and efficiently.

2. Acceptance of Terms

By accessing or using the Services, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. These Terms constitute a legally binding agreement between you and LawSaathi. We may modify these Terms at any time, and such changes will be effective upon posting on our website or notification to you. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

3. Description of Services

Lawsaathi provides an AI-powered platform to streamline legal drafting, case briefing, application writing, and court filing processes, particularly for High Court filings in India. The Services include, but are not limited to:

• Automated legal document creation using LawSaathi's proprietary AI, DELTA, tailored for Indian law.
• Data extraction from legal texts (e.g., FIRs), case sentiment analysis, and citation retrieval.
• Preloaded legal templates, rule suggestions, and multilingual support.
• Cost-effective printing of annexures and supporting documents via LawSaathi Lens. The Services are intended for informational and automation purposes and do not constitute legal advice unless explicitly provided by a licensed attorney engaged through the platform.

4. User Accounts

• Registration: To access certain features, you must create an account and provide accurate, current, and complete information. You agree to update this information as needed.
• Account Security:You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use at [email protected].
• Account Termination: We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms, applicable laws, or misuse of the platform.

5. User Conduct

You agree to use the Services only for lawful purposes and in compliance with these Terms and applicable Indian laws, including the Bar Council of India rules prohibiting solicitation or advertising by advocates. You shall not:

• Use the Services for illegal or unauthorized activities.
• Post or transmit defamatory, obscene, or infringing content.
• Attempt to gain unauthorized access to the Services, DELTA AI, or related systems.
• Disrupt, interfere with, or harm the functionality of the platform. By submitting content (e.g., case details, documents), you grant LawSaathi a non-exclusive, worldwide, royalty-free, perpetual license to use, store, and process such content for providing, managing, or improving the Services. You retain ownership of your content but acknowledge that LawSaathi may retain copies for legal, security, or operational purposes.

6. Intellectual Property

All content, software, AI models (including DELTA), templates, trademarks, logos, and materials provided through the Services (collectively, "Content") are owned by LawSaathi or its licensors and are protected by Indian and International intellectual property laws. You are granted a limited, non-transferable, non-exclusive license to access and use the Services for personal or professional use as permitted. Unauthorized use, reproduction, or distribution of the Content is prohibited.

7. Subscription and Payment

• Fees: LawSaathi operates on a subscription-based model. By subscribing, you agree to pay the applicable fees for the selected plan, which are subject to change with prior notice. Payments are processed through secure third-party payment gateways, and you must provide accurate payment information.
• No-Refund Policy: All payments for plans are non-refundable, and cancellations after purchase are not permitted. Please review plan details carefully before subscribing.
• Taxes: Subscription fees are exclusive of applicable taxes, which will be added as per Indian tax laws.

8. No Legal Advice

Unless explicitly provided by a licensed attorney through the Services, all information, templates, and outputs (including those generated by DELTA AI) are for informational purposes only and do not constitute legal advice. You should consult a qualified attorney for advice specific to your legal needs. LawSaathi is not a law firm and does not engage in the practice of law unless through explicitly engaged licensed professionals.

9. Third-Party Services

The Services may integrate with or link to third-party websites, payment gateways, or services not controlled by LawSaathi. We are not responsible for the content, policies, or practices of such third parties. Your use of third-party services is at your own risk.

10. Disclaimer of Warranties

The Services, including DELTA AI, are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. LawSaathi does not guarantee that the Services will be uninterrupted, error-free, or secure, or that outputs (e.g., documents, citations) will be accurate or suitable for your specific needs.

11. Limitation of Liability

To the fullest extent permitted by Indian law, LawSaathi and its affiliates, officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid for the Services in the preceding 12 months.

12. Indemnification

You agree to indemnify and hold harmless LawSaathi and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice, including for non-payment, violation of these Terms, or misuse of the platform. Upon termination, your right to use the Services will cease immediately, and provisions such as intellectual property, limitation of liability, and indemnification shall survive.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in Prayagraj, Uttar Pradesh, India, in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, and the award shall be final and binding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and LawSaathi regarding the Services.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction.
• Force Majeure: LawSaathi shall not be liable for delays or failures in performance due to causes beyond our reasonable control, including technical failures or force majeure events.
